1. Acceptance of Terms
By accessing or using VerifyMD's services, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services. These terms apply to all users of the platform, including law firm administrators, case managers, and other authorized personnel.
2. Description of Services
VerifyMD provides AI-powered voice agent services that automate provider follow-up calls for plaintiff law firms. This includes balance verifications, lien status checks, medical record requests, and structured reporting. The AI agent operates on behalf of your firm to communicate with medical providers.
3. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials, ensuring the accuracy of information provided, complying with all applicable laws and regulations, and using the service in accordance with these terms. You agree not to misuse the service or use it for unauthorized purposes.
4. Data Ownership
You retain ownership of all data you submit to the platform. VerifyMD does not claim ownership of your case data, call recordings, or verification results. We process your data solely to provide the contracted services.
5. Disbursement Billing
VerifyMD services are billed as case-level disbursements. Fees are logged at the time of verification, attached to the applicable case ledger, and recoverable from the client's settlement proceeds. Your firm is responsible for payment regardless of case outcome.
6. Service Availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform scheduled maintenance with prior notice. We are not liable for temporary service interruptions beyond our reasonable control.
7. Limitation of Liability
VerifyMD provides verification services on a best-effort basis. While we strive for accuracy, we are not liable for errors in information obtained from third-party providers. Users should independently verify critical information before making settlement decisions.
8. Intellectual Property
All intellectual property rights in the VerifyMD platform, including software, algorithms, voice agent technology, user interface designs, and documentation, are owned by VerifyMD, Inc. Your use of the service does not grant you any ownership rights in our technology.
9. Termination
Either party may terminate this agreement with 30 days' written notice. Upon termination, we will provide a reasonable period to export your data. We reserve the right to suspend accounts that violate these terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Delaware.
